Welcome to the Community Solutions Advisory Service Learning Management System (“LMS”), managed by Open North. The following terms and conditions are important things that you should know before using or accessing the LMS. By accessing or using any part of the LMS, you agree to be bound by the following terms and conditions of use. If you do not wish to be bound by these terms and conditions, you may not access or use opennorth.lms.ca. These terms and conditions of use may be changed at any time by Open North without any notice to you. Your continued access and use of this website will mean that you agree to be bound by the most current version of the terms and conditions of use. Please check these terms and conditions periodically for any changes that have been made.

As a public user, you will be allowed access of 3 months from the moment of your registration. In order to extend your access until the end of the program, you may sign up for the Community Solutions Network Advisory Service. Visit www.communitysolutionsnetwork.ca for more information. 

The LMS is intended to serve as a learning resource to help participant communities acquire knowledge and develop skills pertaining to the Open Smart City Domains

In the course of providing this online service, information is exchanged back and forth between the LMS servers, online users, and their browsers. Upon registration, you will be asked to input your name, e-mail address, and other information. You may interact and exchange information with other users in the discussion forum section as well. While you can visit the homepage without registering or providing any personal information, you will need to register if you want to access the courses.

Open North reserves the right to remove any discussion forum submissions that are deemed to be offensive, illegal, off-topic or inappropriate in any way.

In some places on this site you may be asked to list your name, email address, and other personal information. The information we collect is used to inform partners and donors about Community Solutions Network’s activities, programs, special events and ways to support our efforts. It will also be used to generate statistics and reports for internal use only. These statistics and reports will not contain any personally identifiable information.

Open North complies with the Canadian Personal Information Protection and Electronics Documents Act (PIPEDA), the Alberta and British Columbia Personal Information Protection Acts (PIPA) as well as Canada’s Anti-Spam Legislation (CASL).

Open North reserves the right to cooperate with local, provincial and federal officials in any investigation requiring either personal information—including any personal information provided online through lms.opennorth.ca — or reports about lawful or unlawful user activities on this site.

It is the policy of Open North that all information regarding donors, supporters and staff of Open North are maintained in the strictest confidence by Open North and its employees. Furthermore, Open North will not disclose, sell, or trade personal donor and volunteer information to any external party. The information will only be used by Open North for the purposes for which it was collected as disclosed by volunteers and employees of Open North.

As with many other websites, the LMS does use cookies to understand better how our website is used. The information from cookies helps us better support our visitors. We do not collect or retain personal information with cookies.

The information provided on the LMS is provided on an "As Is" basis and for general informational purposes only. Open North does not guarantee whatsoever the accuracy, completeness, fitness for a particular purpose or non-infringement of proprietary rights regarding any information, materials or other documents, which are on, or referenced by, or linked to, the LMS. Neither will Open North be held responsible for incorrect information or typographical errors on the LMS.

Open North shall not be responsible or liable, directly or indirectly, for the accuracy, content, timeliness, completeness, legality, reliability, quality, suitability or decency of any information, advice, content, service, product or merchandise contained on the LMS or in sites linked to or from the the LMS.

Under no circumstances will Open North or any of its officers, directors, shareholders, employees, affiliates, agents, sponsors, licensors, or any other party involved in creating, producing, or distributing Open North's content be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to loss of profits, goodwill, use data or other intangible losses) that result or arise from (a) the use of and reliance on the LMS or the information thereon, (b) the inability to use the LMS, (c) mistakes, omissions, interruptions, suspension, termination, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance with respect to the LMS, including without limitation those that result from acts of god, communications failure, theft, destruction, or unauthorized access to Open North's records, programs, or services, (d) merchandise, products, or services received through or advertised on LMS and merchandise, products, or services received through or advertised on any links provided on LMS, (e) information or advice received through or advertised on the LMS and information or advice received through or advertised on any links provided on the LMS and (f) any information, data, text, messages and other materials that you email, post, upload, reproduce, transmit or otherwise distribute using the LMS.

Because some jurisdictions do not allow the restriction, exclusion or limitation of liability for, in such jurisdictions liability is limited to the fullest extent permitted by law.

If you are dissatisfied with any portion of LMS or with any of these terms of use, your sole remedy is to discontinue using the LMS.

The underlying HTML, text, and other content made available to you on LMS is protected by copyright, trademark and other proprietary rights and does not convey or create any license or other rights in such proprietary rights. You may download the content on the LMS only for your personal use and for non-commercial purposes only.

The Open North text-based information may only be reproduced, stored or transferred electronically for personal or community use. Reference must be given to Open North and any other authors, where applicable.

Images and photographs may not be reproduced, stored, made available, or transmitted without the express permission of Open North.

None of the information or images on the LMS may be resold in any manner, including restricted or commercial on-line systems, without the express permission of Open North. Please keep this notice attached.
